Tl;dr: play fair, don’t use bots. Everything in the game, including anything you buy, is virtual and has no cash value. Bribes are real game features, openly labelled, and everyone can see who used them. No refunds for virtual items once delivered, except where the law says otherwise.
1. Who we are
Ponzi Potato (ponzipotato.com, “the game”) is run by SANTiHANS GmbH, CH-4056 Basel, Switzerland (“we”). See the imprint for contact details.
2. The game
Ponzi Potato is a free browser game and a parody. You don’t need an account to play: we create a guest farm for you on your first action, tied to a cookie in your browser. You can save it to your email address at any time and sign in on other devices with a one-time link.
The game is not an investment, not a pyramid scheme and not gambling. No money is ever paid out to players. See the disclaimer.
3. Your account
- Keep access to your email address safe: anyone who can open your sign-in links can play your farm.
- Your nickname is public (leaderboard, pyramid). Keep it friendly; we may change names that aren’t.
- You can delete your account at any time from the account page.
- You must be at least 16, or have permission from a parent or guardian, especially for purchases.
4. Play fair
Don’t:
- use bots, scripts, auto-clickers or modified clients, or automate the game in any way;
- create multiple accounts to invite yourself or to farm invite bonuses;
- attack, overload or reverse-engineer the service beyond normal play;
- exploit bugs instead of reporting them to us.
The game runs on our servers and we may detect unusual activity. We may reset farms, remove scores, hide players from public lists or close accounts that break these rules, without refund for purchases made to gain an advantage through cheating.
5. Invites and the potato pyramid
Inviting friends gives you in-game bonuses only (bigger virtual land, more virtual customers). Who invited whom is shown publicly by nickname on the pyramid page. Invite bonuses count only for real players who reach the second stage of the game, from a different network than you, and for at most five new recruits per day. Bonuses are capped.
6. Purchases (the black market)
- Shop items are virtual goods with no cash value. They can’t be exchanged for money, transferred to other players or withdrawn.
- Some items buy advantages (“bribes”). This is intentional and transparent: the leaderboard shows which players bought advantages and how much they spent. The leaderboard has no prizes.
- “Rain” is shared: it speeds up every player’s farm for the time bought, and shows your nickname. Rain can be booked at most six hours ahead.
- Some items have limits (for example four golden shovels, or two bribes per season), shown in the shop. If a purchase can’t be delivered in full, for example because two checkouts overlapped or the rain calendar is full, you get the undelivered part refunded automatically.
- Prices are shown in US dollars. Payments are processed by Stripe; we never see your card details. Taxes are included where applicable, as shown at checkout.
- Items are delivered to your farm immediately after payment. By buying, you agree to immediate delivery and acknowledge that, where applicable (for example for consumers in the EU), you thereby lose your right of withdrawal for digital content. Your statutory rights otherwise remain unaffected.
- If a payment is refunded or charged back, the item is taken back where possible (shovels and bribes). Chargebacks may also lead to the account being hidden from public lists.

7. Changes to the game
The game is a living thing. We may change rules, balance, prices and features, reset leaderboard seasons, or end the game. If we shut down the game, we will try to give notice in advance.
8. Liability
The game is provided as is. To the extent permitted by law, we exclude liability for indirect damages, lost data and lost virtual items, and our total liability is limited to the amount you paid us in the twelve months before the claim. Liability for intent and gross negligence, and any liability that cannot be excluded by law, remains unaffected.
9. Law and jurisdiction
These terms are governed by Swiss law. The courts of Basel-Stadt, Switzerland, have jurisdiction, except where mandatory consumer law gives you the right to sue at home.
